Since the start of the full-scale war, Ukraine\u2019s energy policy has shifted from long-term regulatory planning to rapid crisis response. The primary objective has become ensuring the survivability, resilience, and operational continuity of the energy system<\/strong> under conditions of physical destruction, power shortages, and grid instability.<\/p>\n

In this context, battery energy storage systems (BESS)<\/strong> have moved from being a \u201cfuture-oriented technology\u201d to a practical and essential tool for energy security today<\/strong>.<\/p>\n

Wartime Regulation as a Separate Legal Framework for Energy Projects<\/h2>\n

Beginning in 2023, Ukraine introduced a special wartime legal framework aimed at accelerating the deployment of distributed generation and energy storage infrastructure. This framework does not eliminate regulation altogether; rather, it temporarily postpones a number of procedures<\/strong> that are mandatory under peacetime conditions.<\/p>\n

The simplified regime applies to a broad range of energy assets, including generators, cogeneration units, modular boiler houses, energy storage systems, and related engineering networks.<\/p>\n

A key regulatory shift at the end of 2025 was the removal of all capacity thresholds for BESS<\/strong>. As a result, the simplified procedure now applies equally to large-scale industrial projects and to smaller systems deployed by businesses or municipal infrastructure operators.<\/p>\n

What \u201cSimplified Procedure\u201d Means in Practice<\/h2>\n

Under the wartime framework, BESS projects can be deployed without completing many of the standard regulatory steps typically required for construction and commissioning. In particular, projects may proceed without:<\/p>\n

    \n
  • \n

    urban planning documentation and zoning approvals;<\/p>\n<\/li>\n

  • \n

    urban development conditions and restrictions;<\/p>\n<\/li>\n

  • \n

    mandatory project design expertise;<\/p>\n<\/li>\n

  • \n

    formal permits for construction works;<\/p>\n<\/li>\n

  • \n

    full commissioning certification procedures.<\/p>\n<\/li>\n<\/ul>\n

    Land plots may also be used without changing their designated purpose<\/strong>, subject to agreement with the landowner or authorized land manager.<\/p>\n

    In practical terms, the state has adopted the following approach:<\/p>\n

    \n

    first \u2014 deploy and operate critical energy infrastructure;
    later \u2014 align it with the full regulatory framework.<\/em><\/p>\n<\/blockquote>\n

    A Critical Caveat: This Is a Deferral, Not an Amnesty<\/h2>\n

    One of the most common misconceptions is to treat the simplified wartime regime as permanent legalization. In reality, it operates under the principle of \u201coperate now, legalize later.\u201d<\/strong><\/p>\n

    After the termination or cancellation of martial law, all facilities deployed under the simplified procedure must be brought into full compliance with standard legal requirements. This includes:<\/p>\n

      \n
    • \n

      formalization of land use rights, where required;<\/p>\n<\/li>\n

    • \n

      development of full project design documentation;<\/p>\n<\/li>\n

    • \n

      completion of mandatory project expertise;<\/p>\n<\/li>\n

    • \n

      official commissioning and registration of the facility.<\/p>\n<\/li>\n<\/ul>\n

      Failure to complete these steps creates significant legal and financial risks<\/strong>, including limitations on operation, barriers to financing or insurance, and challenges related to asset transfer or sale.<\/p>\n

      Implications for Renewable Energy and Energy Storage Development<\/h2>\n

      For the renewable energy sector, the current regulatory approach represents a window of opportunity<\/strong>, but not a shortcut without consequences.<\/p>\n

      Today, BESS already:<\/p>\n

        \n
      • \n

        enhance grid resilience and flexibility;<\/p>\n<\/li>\n

      • \n

        enable higher penetration of renewable energy sources;<\/p>\n<\/li>\n

      • \n

        reduce operational risks for businesses and critical infrastructure.<\/p>\n<\/li>\n<\/ul>\n

        At the same time, each project implemented under wartime conditions should incorporate a post-war legal compliance strategy<\/strong> as an integral part of its financial and investment planning.<\/p>\n

        Conclusion<\/h2>\n

        The simplified regime for battery energy storage systems is an emergency response tool<\/strong>, designed to function under extraordinary circumstances rather than as a permanent regulatory model.<\/p>\n

        For Ukraine, it provides an opportunity to rapidly strengthen energy flexibility and lay the groundwork for post-war energy transformation.
        For businesses and investors, it offers speed \u2014 but only when combined with foresight, legal planning, and long-term responsibility<\/strong>.<\/p>\n
