The Verkhovna Rada is proposed to abolish VAT and import duties on energy equipment

The draft laws with the relevant amendments to the Customs Code were registered by MP from the “Servant of the People” party Andriy Motovylovets.

Draft Law No. 11343 provides for the exemption from value added tax of importation, transportation (shipment) in international postal and express mail to the customs territory of Ukraine under the customs regime of importation of goods specified in paragraphs 9-35 of Section XXI “Final and Transitional Provisions” of the Customs Code of Ukraine.

VAT is also exempted on imports of goods into the customs territory of Ukraine under the import regime, which are carried out under sale and purchase agreements to which the Energy Community Secretariat is a party, concluded between suppliers of goods and/or service providers and business entities licensed for certain types of economic activities in the electricity (generation, transmission or distribution) and natural gas (transportation, distribution and supply) markets.

The privilege is valid until the end of martial law, but no later than June 1, 2025.

Draft Law No. 11344 provides for the addition of paragraph 9-35 to the Final Provisions of the Customs Code with a list of goods exempt from import duties:

  • hydraulic turbines,
  • water steam turbines and other steam turbines,
  • electric generating sets and rotating electric converters (from 7.5 kV-A to 375 kV-A, 375-750, over 750),
  • inverters with a capacity of no more than 7.5 kV-A,
  • photovoltaic cells assembled in modules or mounted in a panel,
  • components for the production of transformers.

The change should also be in effect until June 1, 2025.

As a reminder, Global 100% RE Ukraine and representatives of the renewable energy industry raised the issue of temporary abolition of import duties at a recent press conference.
