The procedure for customs clearance of biomethane transported by pipelines has been published

The Official Gazette of Ukraine has published Order of the Ministry of Finance of Ukraine No. 380 “On Amendments to Certain Regulatory Acts of the Ministry of Finance of Ukraine on Customs Affairs”.

The Order was issued on August 1 and registered with the Ministry of Justice on August 15, 2024. After publication, on September 10, it comes into force.

The document defines the procedure for customs clearance of biomethane transported by pipeline.

The passage of biomethane through the customs border of Ukraine by pipelines will be carried out on the basis of:

a periodic customs declaration;
a certificate of compliance with biomethane sustainability criteria;
documents confirming the connection of the biomethane producer to the gas transmission or gas distribution system using an automatic flow device (automatic chromatograph), gas metering unit;
an act of acceptance and transfer of the produced biomethane;
an act of the Ukrainian gas storage operator on the movement of natural gas and/or biomethane in gas storage facilities, which is recorded on the customer’s storage account.

The release of biomethane under the customs regime of export across the customs border of Ukraine by pipelines is carried out on the basis of:

an additional declaration (additional declarations) indicating accurate information on the volume of biomethane transported across the customs border of Ukraine;
proof of sustainability of biomethane (Proof of Sustainability);
a general act of acceptance and transfer of natural gas by carriers;
a certificate of the Ukrainian GTS operator on the accounting of commercial supplies and withdrawals of natural gas and/or a mixture of gases, biomethane of the customer (biomethane producer).

“This is a critically important step that allows biomethane producers to carry out customs clearance of renewable gas when it is transported by pipeline from Ukraine to the EU,” the Bioenergy Association of Ukraine explains on its Facebook page. “A lot of experts from both governmental and non-governmental organizations were involved in resolving the issue of customs clearance of biomethane. This is the result of effective cooperation and visionary decisions that will contribute to the development of our economy.”
